Terms of Service

Last updated: July 7, 2026 · These Terms govern your use of Xpat Spain ("Xpat", "we", "us"), operated by Jose Ricardo Diaz Garcia, Lima, Peru. Contact: support@xpatspain.es.

1. What Xpat Spain is — and what it is not

Xpat Spain is an AI-assisted document-preparation and information service for people relocating to Spain. We diagnose your situation, explain the standard Spanish immigration processes, and — in our paid packages — prepare personalized materials such as completed application forms, drafted letters, document checklists, fee calculations, and filing timelines.

Xpat Spain is not a law firm, not a gestoría administrativa, and not a licensed immigration or tax advisor. We do not provide legal representation, formal legal opinions, or tax advice. Nothing in our service creates an attorney-client or advisor-client relationship. You file all applications yourself, in your own name, as the standard Spanish immigration process permits.

For complex situations (including asylum, criminal records, litigation, or corporate structuring) we will recommend that you consult a qualified professional.

2. No guarantee of outcomes

Visa, residency, mortgage, and administrative decisions are made exclusively by Spanish authorities, consulates, banks, and other third parties. We do not and cannot guarantee approval of any application. No legitimate party can. Our service improves the quality and completeness of your filing; it does not and cannot determine its outcome.

3. Accuracy of information and thresholds

Spanish immigration requirements, income thresholds, fees, and tax rules change. We verify our reference figures periodically and state the verification date where relevant, but you are responsible for confirming current requirements with official sources before filing. Official figures published by Spanish authorities always prevail over any figure provided by Xpat Spain.

5. Paid packages and billing

Our paid packages (currently Starter, Execution Kit, and Concierge) are one-time purchases of digital deliverables and time-limited support windows, as described at the point of sale. Prices are shown before purchase.

Payments are processed by Paddle, acting as Merchant of Record. Your purchase is completed through Paddle's checkout, Paddle's buyer terms apply to the transaction, and Paddle handles payment processing, applicable taxes, and invoicing. Refunds are governed by our Refund Policy.

6. Support windows

Each package includes a support window (e.g., 30, 60, or 90 days) starting on the date of purchase, during which you may ask follow-up questions related to your case through the service. Support windows are not extended by inactivity and do not renew.

7. AI-generated content

Parts of the service are provided through an AI assistant. AI outputs may contain errors. Paid deliverables in the Execution Kit and Concierge tiers include a review step, but Section 4 applies in all cases: you must review all documents before use. If you find an error in a paid deliverable, report it within your support window and we will correct it at no charge (see Refund Policy).

8. Intellectual property

The materials we prepare for you are yours to use for your own application. The service itself — including its content, structure, and know-how — remains our property. You may not resell, redistribute, or commercially exploit the service or its outputs.

9. Limitation of liability

To the maximum extent permitted by law, Xpat Spain's total liability arising from or related to the service is limited to the amount you paid for the package in question. We are not liable for indirect or consequential losses, including denied applications, missed deadlines caused by third parties (consulates, translators, couriers, authorities), travel or relocation costs, or loss of income. Nothing in these Terms limits liability that cannot be limited by applicable law, including mandatory consumer protections in your country of residence.

Our handling of your personal data is described in the Privacy Policy.

11. Changes to the service or these Terms

We may update the service and these Terms. Material changes will be reflected on this page with a new "last updated" date. Changes do not affect packages already purchased.

12. Governing law and disputes

These Terms are governed by the laws of the Republic of Peru, without prejudice to mandatory consumer protection rules of your country of residence. Before initiating any formal proceeding, please contact us at support@xpatspain.es — most issues are resolved directly.
